4. Participant details
Minor participantA specific minor authorisation signed by a parent or legal guardian is required. The unassisted weight room cannot be booked. A separate booking is required for each minor.
Parent / legal guardian details
The electronic invoice is generated automatically after every confirmed payment. An Italian tax code is not required for foreign clients. For a minor, the invoice is issued to the parent/guardian making the booking and payment.

GYM RULES AND RESPONSIBILITY DECLARATION - FONTE LIVING WELLNESS
1. OPENING HOURS, ACCESS AND CAPACITY
- The gym is open every day from 08:30 to 19:30; the last bookable gym access is at 18:30.
- Access and activities take place at the booked times. The unassisted weight room has a maximum capacity of 4 people at any one time; organised classes and activities are subject to the specific capacity set by the facility.
- Access is reserved for Fonte Living guests and registered external users with a valid booking.
- Persons under 18 may not use the unassisted weight room independently. They may participate only in classes and activities expressly indicated by the facility as suitable for minors, with prior authorisation from a parent or legal guardian.
2. HYGIENE AND USE OF THE FACILITIES
- Use a personal towel, or one provided by the facility, on equipment where required.
- Clean equipment after use with the products provided.
- Wear suitable sportswear and clean, appropriate footwear.
- Return weights, dumbbells and accessories to their designated places after use.
- Food and drinks other than water are not permitted in the training area. Products purchased from the Wellness fridge must be consumed only in areas where this is allowed.
3. SAFETY
- Do not use equipment unless you know how to operate and adjust it safely.
- Report malfunctions, damage or signs of tampering to Reception immediately.
- Stop exercising if you feel unwell, experience pain or encounter any condition that makes it unsafe to continue.
- Users should exercise only when they consider themselves able to do so safely and should seek medical advice beforehand if in doubt. This declaration does not replace any medical certificate that may be required by applicable law or by the organiser of the activity.
- When using the weight room independently, an instructor, personal trainer or other qualified member of staff may not be present.
4. CONDUCT, PRIVACY AND PERSONAL BELONGINGS
- Behave respectfully towards other users, staff and the facility and do not occupy equipment longer than necessary.
- Smoking is prohibited in the gym and service areas.
- Personal Bluetooth speakers are not permitted and users must not alter the music selected by the facility; headphones and earphones may be used.
- Do not use your phone in speaker mode. Photos and videos are permitted only with the facility's prior authorisation and in compliance with the rights and privacy of other people present.
- Use the lockers for personal belongings. Liability for loss, theft or damage to personal belongings is governed by applicable law and by any custody obligations expressly undertaken by the facility.
5. INTERRUPTION OR RESTRICTION OF ACCESS
For safety reasons or in the event of a breach of these rules, the facility may stop an activity in progress or temporarily restrict access to the extent necessary to protect people, equipment and premises, without prejudice to any mandatory rights of the customer under applicable law.
6. DECLARATION BY THE ADULT USER
The undersigned, identified by the details entered in the booking form:
1) voluntarily requests access to the gym or participation in the booked activity and confirms having read these rules;
2) understands that physical activity involves inherent risks and undertakes to use the facilities and equipment carefully, following posted instructions and staff directions;
3) undertakes to stop the activity immediately whenever it cannot be continued safely;
4) is responsible, in accordance with applicable law, for damage caused intentionally or negligently to equipment, premises or third parties;
5) acknowledges that this document does not exclude or limit the liability of AUTENTICO FP - SOCIETA' A RESPONSABILITA' LIMITATA, based at VIA OSTILIA 4/B - 00184 - ROMA (RM), where such liability cannot lawfully be excluded or limited, including cases of wilful misconduct or gross negligence, defects in the facilities or equipment, or acts or omissions attributable to the facility or its personnel.
7. SPECIFIC APPROVAL
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, where applicable, the customer specifically approves clause 5 concerning the possibility of stopping an activity or temporarily restricting access for safety reasons or breach of the rules. This approval does not waive any mandatory consumer rights and does not limit liability that cannot lawfully be excluded.
The undersigned confirms having carefully read this document, understood its contents and signed it freely and knowingly.
AUTHORISATION AND RESPONSIBILITY DECLARATION FOR A MINOR ATTENDING FITNESS CLASSES
To be completed and signed by a parent or legal guardian.
The parent/guardian, identified by the details entered in the booking form, declares that they exercise parental responsibility for, or are the legal guardian of, the minor identified in the booking and are entitled to give this authorisation.
1. AUTHORISATION
The parent/guardian AUTHORISES the minor to enrol in and attend fitness classes and sports activities organised by Fonte Living that the facility expressly indicates as suitable for minors, and confirms having read the gym rules and applicable safety instructions.
2. SCOPE AND LIMITS
- This authorisation does not allow the minor to use the unassisted weight room independently.
- Each minor requires an individual booking and the relevant authorisation from a parent/guardian.
- This authorisation does not replace any medical certificate or other documentation that may be required by applicable law or by the organiser of the activity.
3. UNDERTAKINGS OF THE PARENT/GUARDIAN
The parent/guardian:
- undertakes to provide accurate and up-to-date details for the minor and the signer;
- undertakes to ensure that the minor complies with the gym rules, safety requirements and instructions given by staff or instructors;
- acknowledges that physical activity involves inherent risks and that the minor must stop the activity if they feel unwell, experience pain or encounter any condition that makes it unsafe to continue;
- acknowledges that liability for loss, theft or damage to personal belongings is governed by applicable law and by any custody obligations expressly undertaken by the facility.
4. INTERRUPTION OF PARTICIPATION
For safety reasons or in the event of a breach of the rules or staff instructions, the facility may stop an activity in progress or temporarily restrict the minor's participation to the extent necessary to protect the minor, other users, staff, equipment and premises, without prejudice to mandatory rights under applicable law.
5. LIABILITY OF THE FACILITY
This authorisation does not exclude or limit the liability of AUTENTICO FP - SOCIETA' A RESPONSABILITA' LIMITATA, based at VIA OSTILIA 4/B - 00184 - ROMA (RM), its legal representatives, employees, contractors or instructors where such liability cannot lawfully be excluded or limited, including cases of wilful misconduct or gross negligence, defects in the facilities or equipment, or acts or omissions attributable to the facility or its personnel. This authorisation has no effect as a waiver of criminal liability.
6. SPECIFIC APPROVAL

PRIVACY NOTICE - FONTE LIVING WELLNESS
Data controller: AUTENTICO FP - SOCIETA' A RESPONSABILITA' LIMITATA, VIA OSTILIA 4/B - 00184 - ROMA (RM). Privacy contact: autentico.fp@legalmail.it. If a Data Protection Officer (DPO) is appointed where required, the relevant contact details will be made available by the Controller.
Purposes and legal bases: registration and account creation; booking and provision of the requested gym/classes/services; payment management and customer assistance; administrative, accounting, tax and invoicing obligations; security, fraud prevention and the establishment, exercise or defence of legal claims. Processing necessary to perform the contract or take pre-contractual steps is based on Article 6(1)(b) GDPR; processing required by law is based on Article 6(1)(c); security and defence of rights may be based, where applicable, on the Controller's legitimate interests under Article 6(1)(f), after the required balancing. Marketing is not part of the booking and requires a separate consent if introduced.
Data processed: identification and contact details, date and place of birth, nationality and residence, identity/passport details, tax and invoicing data, booking and purchase details, payment references, signed declarations and technical evidence used to document the signing/acceptance process. For minors, the system also processes the identification and contact details of the minor and the parent/legal guardian. The booking form does not ask for diagnoses or clinical information.
Required data: fields marked as required are necessary to manage the requested service, identify the contracting/signing person where applicable, create the customer account, process payment, issue the required tax document and comply with legal obligations. Without the required data, the booking or purchase cannot be completed.
Recipients: authorised personnel and service providers necessary for hosting/IT operation, payment processing, accounting/tax compliance and other services strictly necessary for the purposes above, as well as public authorities where required by law. Invoice XML files are generated by the system and are uploaded by authorised staff to the invoicing service.
International transfers: where a service provider entails transfers outside the EEA, the transfer must be carried out in accordance with Chapter V GDPR using the applicable adequacy decision or appropriate safeguards.
Retention: tax and accounting records are kept for the statutory retention periods. Booking, contractual, signed-declaration and audit records are kept for the period necessary to provide the service, meet legal obligations and establish, exercise or defend legal claims; afterwards they are deleted or anonymised when no longer necessary.
Automated processing: the system may calculate operational indicators and generate management alerts. It does not take decisions based solely on automated processing that produce legal effects or similarly significantly affect the customer.
Rights: under the conditions laid down by the GDPR, the data subject may exercise the rights of access, rectification, erasure, restriction, objection and portability and may lodge a complaint with the competent supervisory authority; in Italy, the Garante per la protezione dei dati personali.
Acknowledging this notice is not consent to marketing and does not waive any data-protection right.
